This is one of those “I am not a lawyer but” posts.
I don’t know a whole lot about photographic rights either. But it was my impression that various agencies license the work of photographers for various purposes.
I am writing about the Getty Images photo altered on the Fox website that was the subject of my post on Fox Fake News a few days ago. In this case it is a license which probably includes both television and internet rights. But is the photograph supposed to be used “as is” or does the license include the right to alter the photo (even to the extent that it is misleading).
I am not a lawyer but it seems to me that both the agency and the photographer should look into the possibility that Fox may owe them some damages.
