The Rowan County Kentucky Clerk’s Office has decided not to obey the law and issue marriage licenses to gay couples despite a Supreme Court Ruling making same-sex marriage a right nationwide. The Rowan County Clerk Kim Davis claimed doing so would be a violation of her religious rights.
However, U.S. District Court Judge David Bunning felt differently and ordered the office to issue marriage licenses to same sex couples. His decision includes the following in USA Today:
“She may continue to attend church twice a week, participate in Bible study and minister to female inmates at the Rowan County jail,” Bunning wrote. “She is even free to believe that marriage is a union between one man and one woman, as many Americans do. However, her religious convictions cannot excuse her from performing the duties that she took an oath to perform as Rowan County clerk.”
According to the same article despite a federal judge’s order the Rowan County Clerk’s Office is still refusing to issue marriage licenses to same sex couples. This seems to be beyond absurd. It seems that officials need to follow the law. If they feel this interferes with religious beliefs, they are free to resign.
If they refuse to resign and refuse to follow the law they should be removed from office. If neither, a little jail time for contempt of court may also be in order.
